Terms of Service

Welcome to Filmaro (bundle ID: org.reels.wizard). These Terms of Service ("Terms") govern your use of the Filmaro application ("the App") provided by the Filmaro Team ("we," "us," or "our"). By accessing or using Filmaro, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. Acceptance of Terms

By creating an account or using Filmaro, you confirm that you are at least 13 years old (or 16 in the EEA) and that you accept these Terms in their entirety. If you are using the App on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2. Description of Service

Filmaro is an AI-powered photo and video creation application. The App allows you to:

• Create AI-generated portraits by swapping your face into professional photo templates
• Generate creative photo collages with AI-powered face replacement
• Create AI dance videos from a single photo
• Generate UGC (user-generated content) product videos with AI influencers
• Create product posters with AI-generated backgrounds
• Access a library of hundreds of templates across multiple categories

Features and capabilities may change as we continue to develop the service.

3. Account Registration

To access most features, you must create an account. You agree to:

• Provide accurate and complete information during registration
• Keep your account credentials secure and confidential
• Notify us immediately of any unauthorized use of your account
• Be responsible for all activity under your account

We may suspend or terminate accounts that violate these Terms or are used fraudulently.

4. Subscriptions and Payments

• Plans: Filmaro offers Free, Pro, and Premium subscription tiers with varying credit allocations and features.
• Auto-Renewal: Paid subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before renewal.
• Payment Processing: All payments are handled by the Apple App Store or Google Play Store. We do not collect, process, or store your payment card information.
• Price Changes: We may change subscription prices with advance notice. Changes take effect at the start of the next billing period.
• Refunds: Refund requests must be directed to Apple or Google per their respective refund policies. We do not issue refunds directly.
• Cancellation: Cancel anytime through your device's App Store or Play Store settings. You retain access until the end of the current billing period.

5. Credits System

• AI generation features consume credits. Different features cost different amounts of credits.
• Paid subscriptions include a monthly credit allocation that refreshes each billing cycle.
• Unused credits from a billing period do not roll over.
• We reserve the right to adjust credit costs for specific features with advance notice.
• Credits have no monetary value and cannot be transferred, sold, or exchanged.

6. User Content and Ownership

You retain full ownership of the photos, videos, and other content you upload ("User Content"). By using the App, you grant us a limited, non-exclusive, royalty-free license to:

• Process your User Content through AI systems to deliver requested services
• Temporarily store your User Content as necessary for processing
• Store generated results in cloud storage for your access

This license exists solely to provide the App's services. We do not use your content for marketing, advertising, AI model training, or any purpose beyond delivering your requested generation without your explicit consent.

7. AI-Generated Content

Content produced by Filmaro's AI is generated by artificial intelligence. You acknowledge and agree that:

• AI results may not always be accurate, appropriate, or meet your expectations
• We do not guarantee specific outcomes or quality levels
• You are solely responsible for reviewing and using any AI-generated content
• You must ensure your use of AI-generated content complies with applicable laws and does not infringe on others' rights
• You own the AI-generated outputs created from your User Content, subject to our intellectual property rights in the underlying templates and technology
• We are not liable for consequences arising from your use or distribution of AI-generated content

8. Biometric Data Consent

Filmaro processes facial imagery to provide face swap, AI portrait, collage, and dance video features. By uploading photos containing faces, you:

• Acknowledge that your facial features constitute biometric data under certain laws (including GDPR Article 9 and Illinois BIPA)
• Provide explicit, informed consent for the collection and processing of this biometric data
• Understand that this data is sent to third-party AI services (fal.ai, FASHN.ai, Google Gemini) for processing
• May withdraw consent at any time by deleting your account or contacting us

You must only upload photos of yourself or photos for which you have obtained the explicit consent of the person depicted.

9. Acceptable Use

You agree not to use Filmaro to:

• Create, upload, or distribute illegal, harmful, threatening, abusive, defamatory, or otherwise objectionable content
• Generate deepfakes or manipulated media intended to deceive, defraud, harass, or harm others
• Create content that infringes intellectual property rights of others
• Upload photos of other people without their consent
• Engage in harassment, impersonation, or identity fraud
• Create non-consensual intimate imagery
• Bypass security measures, rate limits, or access restrictions
• Use automated systems (bots, scrapers) to access the App
• Reverse engineer, decompile, or extract the source code
• Resell, redistribute, or sublicense access to the App

We may remove content and suspend or terminate accounts that violate these guidelines without prior notice.

10. Intellectual Property

The Filmaro application, including its design, code, templates, AI models, trademarks, and all related intellectual property, is owned by the Filmaro Team and protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works based on any part of the App without prior written consent.

11. Indemnification

You agree to indemnify, defend, and hold harmless the Filmaro Team from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use or misuse of the App
• Your violation of these Terms
• Your infringement of any third-party rights
• Content you create, upload, or distribute through the App

12. Limitation of Liability

To the maximum extent permitted by law:

• Filmaro is provided "as is" and "as available" without warranties of any kind, express or implied.
• We do not warrant uninterrupted, error-free, or secure operation.
• We shall not be liable for any indirect, incidental, special, consequential, or punitive damages.
• Our total liability shall not exceed the amount you paid to us in the 12 months preceding the claim.
• We are not responsible for content generated by AI or actions taken by third-party services.

13. Termination

We may suspend or terminate your access at any time, with or without cause. Grounds include:

• Violation of these Terms
• Fraudulent or abusive behavior
• Non-payment of subscription fees
• Requests by law enforcement

Upon termination, your right to use the App ceases immediately. Provisions that by nature should survive (limitations of liability, intellectual property, indemnification, dispute resolution) remain in effect.

14. Force Majeure

We shall not be liable for any failure or delay in performance due to causes beyond our reasonable control, including natural disasters, war, terrorism, pandemics, government actions, power failures, internet disruptions, or third-party service outages.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

16. Changes to Terms

We may modify these Terms at any time. Material changes will be communicated through the App or via email. Continued use after changes constitutes acceptance. If you disagree, stop using the App.

17. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Republic of Uzbekistan, without regard to conflict of law principles. Any disputes shall be resolved through good-faith negotiation. If negotiation fails, disputes shall be submitted to the competent courts of the Republic of Uzbekistan.
